Delivery Terms:

The supplier shall be responsible for the delivery of the goods. For items currently in stock, delivery will be completed within 5 to 7 business days following confirmation of payment. For pre-ordered or future goods, the delivery timeline will correspond to the batch and month specified at the time of purchase. Please be advised that delivery schedules may be affected by circumstances beyond the supplier’s control, including but not limited to natural disasters, adverse weather conditions, geopolitical events (e.g., war), pandemics, or manufacturing disruptions. The Seller shall not be held liable for any indirect, incidental, or consequential losses, including but not limited to loss of business, revenue, or opportunity, arising from any such delays in delivery.

Packaging:

All products will be delivered in their original and standard packaging as supplied by the manufacturer.

Damages During Delivery:

The seller accepts responsibility for any damages occurring during shipping or delivery and will replace any damaged items at no extra cost to the buyer.

Taxes and Related Fees:

The buyer shall be responsible for all taxes, customs duties, and shipping charges. These costs are not included in the product price and are the sole responsibility of the buyer.

Acceptance & Inspection:

Upon receipt of the goods, the buyer is entitled to inspect the items. Any claims related to defects must be submitted within 12 hours of receipt. Should the goods be found to be defective, the seller is obligated to address the issue promptly and efficiently.

Order Modifications:

The buyer may cancel an order within 3 hours of making payment. Cancellations will not be accepted after this period. For future goods or pre-orders, cancellations are strictly not permitted under any circumstances, including delays from the manufacturer or supplier.

Order Cancellation:

The buyer may cancel the order within 6 hours of making the payment. After this 6-hour window, cancellations will no longer be accepted.

Refunds:

Please note that there is no refund policy provided by the manufacturer. As a result, no refunds will be issued once payment has been processed. Refunds will only be issued once funds have been received from the supplier or manufacturer. Billion Bison is not liable for issuing refunds from its own accounts unless payment has been received from the supplier or manufacturer.

Future Goods Orders:  

Please note that orders for future goods (such as preorders or items not currently in stock at the time of order) are non-refundable once payment has been processed. 

Modification of Preorder Terms:

Preorder terms may be modified at the request of the buyer within 6 hours of payment. After this period, no changes to preorder terms will be accepted.

Warranty Terms:

All product warranties are provided exclusively by the manufacturer. In the event of any issues arising during the warranty period, Billion Bison, as the seller, will assist the buyer in initiating a warranty claim with the manufacturer. However, Billion Bison is not responsible for the manufacturer’s final decision or the outcome of the claim process.

Warranty terms and durations are determined by the manufacturer and published on their official website. Buyers are encouraged to review these terms directly or may contact Billion Bison for guidance in accessing or interpreting the warranty information.

The seller assumes no liability for any warranty-related delays, rejections, or decisions made by the manufacturer. No replacements or financial compensation will be provided by the seller in cases where a warranty claim is denied.

Limitation of Liability for Irreparable Devices:

If a device malfunctions during the warranty period and is submitted to the manufacturer’s authorized service centre for inspection or repair, and the centre determines that the device is irreparable or categorizes it as “scrap,” Billion Bison shall bear no responsibility or liability. In such cases, the customer shall not be entitled to any form of compensation, replacement, or refund from Billion Bison.

Limitation of Liability:
To the maximum extent permitted by applicable law, Billion Bison shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data, arising out of or in connection with the use or performance of the products, even if advised of the possibility of such damages.

Transfer of Rights:

Preorders are non-transferable and cannot be assigned to another party without the prior written consent of Billion Bison.

Hashrate:

Due to environmental and cooling conditions, the hashrate performance of mining devices may fluctuate by up to ±10%. Such variation is considered normal and does not constitute grounds for claims or returns.

Mining Difficulty & Reward:

As Billion Bison does not control the mining network or its difficulty levels, any changes in mining difficulty that affect rewards are beyond the seller’s responsibility. The buyer acknowledges that mining profitability, uptime, and return on investment (ROI) are not guaranteed by the seller.

Crypto Halving:

In the event that mining rewards are reduced as a result of a scheduled or unscheduled cryptocurrency halving event, Billion Bison shall not be held liable. Reward structures are determined by blockchain protocols and remain outside the control of the seller.

Price Fluctuation:

Once the contract is signed, the product price is fixed. No discounts, refunds, or compensation shall be granted for any subsequent price increases or decreases in the market.

Shipping Delays & Compensation:

In case of shipment delays due to logistical issues, customs clearance, or other circumstances, the buyer is not entitled to compensation, unless expressly agreed upon under a separate arbitration clause.

Algorithm Changes:

If a cryptocurrency changes or switches its mining algorithm (e.g., from Proof-of-Work to Proof-of-Stake), Billion Bison bears no responsibility for replacing or modifying mining equipment to adapt to such changes. The buyer assumes full responsibility for the impact of any such transitions on device utility.

Governing Law & Jurisdiction:

This Agreement shall be governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region and, where applicable, the laws of the People’s Republic of China. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Hong Kongor the People’s Republic of China, depending on the location of the transaction, the parties involved, or the applicable governing authority.

Entire Agreement:

This Agreement constitutes the entire understanding between the Buyer and Billion Bison. It supersedes all prior discussions, negotiations, or representations, whether oral or written. No other conditions, warranties, or promises shall be binding unless explicitly included in this Agreement.

Indemnification:
The buyer agrees to indemnify, defend, and hold harmless Billion Bison and its affiliates, officers, directors, and employees from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or related to the buyer's misuse of the products or breach of this agreement.

Regulatory Compliance:
The buyer is solely responsible for complying with all local laws, regulations, and import/export requirements applicable to the purchase and use of the products.

Severability:

If any provision of this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect and be interpreted to reflect the original intent of the parties as closely as possible.

Non-Waiver:

Failure by Billion Bison to enforce any provision of this Agreement shall not be construed as a waiver of that provision or any other provision in the future. Any waiver must be made explicitly in writing and signed by an authorized representative of the seller.

Data Protection:
Billion Bison shall collect and process personal data of the buyer in accordance with applicable data protection laws. By entering into this agreement, the buyer consents to such processing for order fulfilment, warranty handling, and post-sale communications.

Force Majeure:

Billion Bison shall not be liable for delays or failure to fulfil contractual obligations due to force majeure events, including but not limited to civil unrest, military actions, natural disasters, pandemics, holidays, or other events beyond its control. In such circumstances, Billion Bison will notify the customer promptly by SMS, call, or email. In such cases, the buyer shall not have the right to cancel the order or seek compensation due to the delay.
